Purpose:
Sexual Harassment is a serious offence and it will not to be tolerated within
the International Tae Kwon-Do Foundation of New Zealand.
Rationale:
To ensure all students, instructors and family members who have contact
with ITFNZ will not exposed to Sexual Harassment.
Guidelines:
· Sexual Harassment is offensive, unasked for behaviour. Sexual
harassment generally occurs when a person is subject to unwelcome verbal or
physical conduct of a sexual nature.
It can include:
· Sex orientated, comments, jokes, cartoons, posters, pin-ups
· Offensive questions, comments, abuse, leering
· Unwanted, unnecessary, deliberate physical contact, touching and gestures
· Questions and comments about private life
· Request for sexual favours implying promises of favourable treatment
or threats of unfavourable treatment.
· Sexual Harassment can occur between: -
1. Individuals
2. Individuals and groups
3. Groups
4. Students
5. Students and instructors
6. Students and adults
7. Adults
· Sexual harassment is serious, and can be detrimental to one’s work performance, to learning, as well as to self-esteem and reputation. All instructors and students must be able to work in, learn in, and be a part of, an environment that is free from sexual harassment
· The Executive Committee will ensure that all members of ITFNZ are informed of the nature and implications of sexual harassment, and will act to reduce the risk of its occurrence
· All complaints of sexual harassment will be taken seriously, investigated
quickly, privately and fairly.
If anyone wishes to make an enquiry or a complaint about sexual harassment, they should contact one of the following:
· Their Regional Director
· The Sexual Harassment Officer
· Standards and Discipline Committee

All members of the ITFNZ are to be informed of the nature and implications of
sexual harassment and will act to reduce the risk of its occurrence.

Training will be the responsibility of the Regional Director and Standards & Discipline Committee, who will work with and through the instructors of individual clubs.
ENQUIRES AND COMPLAINTS OF SEXUAL HARASSMENT
Anyone with an enquiry or a complaint about sexual harassment can approach or will be referred to:
· The Regional Director
· Any person designated as a contact person. (Sexual Harassment Officer).
The contact person will give information and, where appropriate, support the
complainant in making a complaint.
· Human Rights Commission
If there is no informal resolution, in consultation with the complainant the person contacted above will notify:
The Regional Director, will seek informal resolution of the complaint in consultation with the complainant wishes.
If a formal complaint is received the Regional Director in consultation with the complainant, will refer the complaint either to the Standards and Discipline Committee or the Human Rights Commission. The complaint will be investigated by the organisation preferred by the complaint.
CONSIDERATIONS OF JUSTICE
The Standards and Discipline Committee is obligated
· To investigate when a written formal complaint is received
· To ensure the instructor/ student is informed about the full allegations
made against them
· To ensure the instructor/ student of their right to be representative
or have a support person present
· To give the respondent a real opportunity to give reasons and explanations
for their conduct
· To consider those reasons before determining whether, on the balance
of probabilities, the complaint has substance, and whether disciplinary action
is appropriate
· To treat the respondents as innocent until proven guilty. Any penalty
imposed, for example, a warning, or in serious cases dismissal, must be relevant
to the particular situation.
· To inform the Executive Committee immediately of all written complaint.
PROCEDURES
(The Standards and Discipline Committee must have documented procedures for them to use as a guideline for investigating a complaint).
· After the Standards and Discipline Committee has carried out their investigation, the Director of the Committee will inform the Executive Committee of their findings and make a recommendation.
· The Executive Committee will make the final decision regarding the complaint and inform the complainant of their decision and any outcomes and actions to be taken.
Unfortunately it is a fact that Sexual Harassment occurs within sporting bodies in New Zealand.
Our Executive Committee must ensure the safety of all of its members.
· It is their responsibility to provide and educate members about sexual
harassment within Taekwon Do and their rights.
· To provide information and resources to reduce the risk of sexual harassment.
· Provide contact people who can assist members when harassment has occurred.
· To have working documents that is adhered to.
· Review policies and procedures on a regular basis.
· To take all complaints as serious.
Attached is a draft copy of a Sexual Harassment Policy that our organisation
could implement.
The Standards and Discipline Committee needs to draw up the procedures that
they could use.
